RESOLUTION NUMBER 15-7255

A RESOLUTION RELATING TO 120 N. 2nd Street

 BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:

 Section 1. The Governing Body finds that the following structure (the “Structure”) is unsafe and dangerous, and that such conditions endanger the life, health, property or safety of the public or the occupants:

Single-family dwelling at 120 N. 2nd Street, Salina, Kansas.

 Section 2. The current owners are directed to repair or remove the Structure, and to make the premises safe and secure. Such work shall be commenced by July 16, 2015, and shall be diligently prosecuted so as to allow for substantial completion of all work no later than August 16, 2015.  If the current owners fail to commence the repair or removal, or to diligently prosecute the work until the work is substantially completed, by August 16, 2015, the Governing Body will cause the Structure to be razed and removed. 
 
 Section 3.  In the alternative, based upon representations relating to the potential sale of the property, if both (a) the current owners or their purchaser provides the Building Official on or before July 16, 2015 with a bona fide contract for the sale of the Structure, signed by all lawful owners and with a closing date on or before July 28, 2015, and (b) the sale closes on or before and the purchaser commences work no later than August 6, 2015; the purchaser shall be allowed until October 17, 2015 for diligent prosecution and substantial completion of all work to make the premises safe and secure.  If the purchaser fails to commence the repair or removal, or to diligently prosecute the work until the work is substantially completed, by October 17, 2015, the Governing Body will cause the Structure to be razed and removed. 

 Section 4. The City Clerk shall publish this resolution one (1) time in the official city newspaper and shall mail, by certified mail, copies of the resolution to each owner, agent, lienholder of record and any occupant of the Structure within three (3) days after its publication.
