9/15/2015 - Ordinance No. 15-10798 Annexation of land located on east side of South Ohio Street south of Schilling Road
ORDINANCE NUMBER 15-10798

    AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.

    BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

    Section 1.  Findings.
    The following findings support the annexation of this property by the City of Salina:
1.    There is a utilities master plan that calls for extension of City utilities into this area.
2.    Annexation is being requested by Saline County in order to have City utilities and services extended to their property.
3.    The subject property is located in the City’s Urban Service Area and is contiguous to the existing city limits on the west.

    Section 2.  That the following described tract of land, to-wit:

DESCRIPTION OF PROPERTY OWNED BY SALINE COUNTY

A portion of the South Half of the Northwest Quarter and all of the Northeast Quarter of the Southwest Quarter of Section Six (6), Township Fifteen South (T15S), Range Two West (R2W) of the Sixth Principal Meridian in Saline County, Kansas, more particularly described as follows:  

Beginning at the Southwest corner of said Northwest Quarter of Section Six (6); thence N. 0° 51' 23" E., on an assumed bearing, along the west line of said Northwest Quarter, a distance of 1118.00 feet; thence  S. 89° 19' 00" E. a distance of 1322.07 feet to a point on the west line of the Southeast Quarter of the Northwest Quarter; thence N. 1° 32' 05" W. along said west line, a distance of 90.43 feet; thence N. 88° 27' 55" E. a distance of 296.00 feet; thence S. 1° 32' 05" E. parallel with said west line of the Southeast Quarter of the Northwest Quarter, a distance of 98.31 feet; thence N. 89° 26' 29" E. a distance of 1039.87 feet to the east line of said Northwest Quarter; thence S. 0° 54' 44" E. along the east line of said Northwest Quarter, a distance of 1147.83 feet to the Southeast corner of said Northwest Quarter; thence S. 0° 56' 18" W. along the east line of the Northeast Quarter of the Southwest Quarter, a distance of 1333.03 feet to the Southeast corner of said Northeast Quarter of the Southwest Quarter; thence N. 89° 09' 53" W. along the south line of said Northeast Quarter of the Southwest Quarter, a distance of 1322.30 feet to the Southwest corner of said Northeast Quarter of the Southwest Quarter; thence N. 0° 51' 52" E. along the west line of said Northeast Quarter of the Southwest Quarter, a distance of 1324.51 feet to the Northwest corner of the Northeast Quarter of the Southwest Quarter; thence N. 88° 58' 14" W. along the south line of the Northwest Quarter of said Section Six (6), a distance of 1369.10 feet to the point of beginning.  

The above described tract contains 110.351 acres.


DESCRIPTION OF PROPERTY ADJACENT TO SALINE COUNTY PROPERTY
DEDICATED TO THE PUBLIC ON LIBERTY ADDITION No. 2 TO THE CITY OF SALINA

A portion of the South Half of the Northeast Quarter of Section One (1), Township Fifteen South (T15S), Range Three West (R3W) of the Sixth Principal Meridian in Saline County, Kansas, more particularly described as follows:  

Beginning at the Southeast corner of said Northeast Quarter of Section One (1); thence   
N. 89° 30' 45" W., on an assumed bearing, along the south line of said Northeast Quarter, a distance of 50.00 feet to the west line of Dedicated property; thence N. 0° 51' 23” E. along said west line, a distance of 1118.32 feet; thence S. 89° 08' 37" E. a distance of 50.00 feet to a point on the east line of said Northeast Quarter; thence S. 0° 51' 23" W. along said east line, a distance of 1118.00 feet to the point of beginning.  

The above described tract contains 1.283 acres.

meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas.  

Section 3.  Zoning.  All property described in Section 2 hereof shall be classified as lying in an A-1 (Agricultural) zoning district.

Section 4.  Repealer. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed.

Section 5.  Summary of ordinance for publication. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.

Ordinance No. 15-10798 Summary

On September 14, 2015, the City of Salina, Kansas passed Ordinance No. 15-10798.  The ordinance annexes a 110.35 acre tract of land owned by Saline County on the east side of South Ohio Street south of Schilling Road and the adjoining Ohio Street right of way to allow City utilities and services to be extended to the property.
