ORDINANCE NUMBER 14-10733

AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES AND PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE PURPOSE OF PAYING A PORTION OF THE COST OF CERTAIN IMPROVEMENTS IN THE CITY.

WHEREAS, the Governing Body of the City of Salina, Kansas (the “City”) has authorized the following improvements (collectively, the “Improvements”) in the City to be constructed pursuant to K.S.A. 12-6a01 et seq.:

PHEASANT RIDGE ADDITION NO. 2
STREET, DRAINAGE AND UTILITY IMPROVEMENTS

The installation of approximately 1,687  lineal feet of six-inch water main, 417 lineal feet of eight-inch water main, fire hydrants, valves, fittings, service connections and all appurtenances thereto for water lines within right of way and/or utility easement (the “Water System Improvements”).

The installation of approximately 1,408 lineal feet of eight-inch sanitary sewer main, 1,249 lineal feet of four-inch force main, relocation of an existing sanitary pump station, service connections, manholes and all appurtenances thereto for sanitary sewer lines lying within right of way and/or utility easement, (the “Sanitary Sewer Improvements”).

The installation of curb & gutter, pavement, and grading for approximately 750 lineal feet of Prairie Lane (the “Prairie Lane Street Improvements”).

The installation of curb & gutter, pavement, and grading for approximately 750 lineal feet of Quail Hollow Drive (the “Quail Hollow Drive Street Improvements”)

The installation of approximately 935 lineal feet of storm sewer, inlets, and all appurtenances thereto for storm sewer lines lying within right of way and/or drainage easement, (the “Drainage Improvements”).

QUAIL MEADOWS ESTATES ADDITION PHASE V
STREET, DRAINAGE AND UTILITY IMPROVEMENTS

The curb, gutter, pavement and grading for approximately 322 lineal feet of Melanie Lane (the “Melanie Lane Street Improvements”) and 835 lineal feet of Rittgers Lane (the “Rittgers Lane Street Improvements”, and collectively, the “Street Improvements”).

The installation of approximately 613 lineal feet of storm sewer pipe, inlets, and all appurtenances thereto (the “Drainage Improvements”).

The installation of approximately 831 lineal feet of six-inch water main, 416 lineal feet of eight-inch water main, fire hydrants, valves, fittings, service connections for water lines and all appurtenances thereto (the “Water System Improvements”).

The installation of approximately 847 lineal feet of eight-inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the “Sanitary Sewer Improvements”).

(collectively, the "Quail Meadows Estates Addition Phase V Improvements").

WHEREAS, the total costs of such improvements have been determined; the Governing Body has caused the assessments against each lot, piece or parcel of land deemed to be benefited by such improvements, to be determined in the manner set forth in the resolution as to advisability of the improvements provided for pursuant to K.S.A. 12-6a04; and an assessment roll has been prepared; and

WHEREAS, such assessment roll was filed with the City Clerk and has been open to public inspection; and

WHEREAS, the City Clerk, at the direction of the Governing Body, caused notice of the hearing on the special assessments to be published not less than 10 days prior to such hearing, and notice to be mailed to the property owners to be assessed, in accordance with K.S.A. 12-6a09 et seq.; and

WHEREAS, the Governing Body held a public hearing to consider the proposed assessments.

 NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

Section 1.  Special Assessments to pay the cost of the following projects are hereby levied against several lots, pieces and parcels of land liable for special assessments for said improvements, as follows:

Section 2.  The special assessments provided for in Section 1 of this Ordinance shall be certified by the City Clerk to the County Clerk in the same manner and at the same time as other taxes are certified.  The assessments and will be collected in fifteen (15) equal annual installments, together with interest on such amounts at a rate not exceeding the maximum rate therefore as prescribed by the Act.  The first installment shall become due with the first payment of general property taxes for the year 2014.  Interest on the assessed amount remaining unpaid between the effective date of this Ordinance and the date the first installment is payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued to finance the Improvements, shall be added to the first installment.  The interest for one year on all unpaid installments shall be added to each subsequent installment until paid. 

Section 3.  Notwithstanding anything to the contrary in this Ordinance, the governing body hereby  authorizes and provides for a delay in the payment of special assessments levied against Unplatted Tract No. 1 (as defined in Section 1), for a period of not to exceed the earlier of:  (a) 15 years after the date of this Ordinance or (b) the date when Unplatted Tract No. 1 is platted or developed and no longer meets the criteria set forth in K.S.A. 12-6,113.

Section 4.  The owner of any piece or parcel of property liable for any such assessments may redeem his property, in whole or in part, from such liability by paying to the City Treasurer the entire amount, or a portion thereof, chargeable against said property, at any time on or before June 2, 2014, and to the extent of any such payment, the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements, nor for any interest due thereon.  
 
Section 5.  This ordinance shall be published by the following summary:

Ordinance No. 14-10733 Summary

On April 28, 2014, the City of Salina, Kansas, passed Ordinance No. 14-10733.  The ordinance levies special assessments to pay the cost of street, drainage and utility improvements in (a) the Pheasant Ridge Addition No. 2 and two adjacent unplatted parcels of land, and (b) the Quail Meadows Estates Addition and a lot in Quail Meadows Commercial Addition.  The Ordinance provides an opportunity for prepayment, in whole or in part, of said special assessments.  A schedule of the amounts of said special assessments and the property benefitted are included in the Ordinance.  Any amount of special assessments not paid within the time prescribed in the Ordinance shall be certified by the City Clerk to the Clerk of Saline County, Kansas, in the same manner and at the same time as other taxes are certified and will be collected in annual installments, together with interest on such amounts at a rate not exceeding the maximum rate therefor as prescribed by law.  A complete copy of the ordinance is available at www.salina-ks.gov or in the office of the city clerk, 300 W. Ash Street, free of charge.  This summary is certified by the city attorney.

Section 6. This ordinance shall be in full force and effect from and after its adoption and publication by summary once in the official city newspaper.
