ORDINANCE NUMBER 25-11256

                                                                                                

AN ORDINANCE AMENDING ORDINANCE NUMBER 8526, CODIFIED AS CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP OF THE CITY OF SALINA, KANSAS BY REZONING AND PRESCRIBING THE PROPER USES OF CERTAIN PROPERTY WITHIN THE CITY.

 

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

 

Section 1.  Application.  Gary Norris has filed Application #Z25-5 requesting a change in zoning district classification from RS (Residential Suburban) to R-1 (Single-Family Residential) in relation to the following described unplatted tract of real estate:

            

A portion of the Southeast Quarter of Section 2, Township 14 South, Range 3 West of the 6th Principal Meridian, City of Salina, Saline County, Kansas described as follows by Nicholas D. Schmidt. PS #1492 this 3rd day of June. 2025:

 

Beginning at the Northeast corner of Block 32, Military Addition, City of Salina, Saline County, Kansas; 

Thence South 89'57’19 West on the North line of said Block 32 and the North line of Block 32 of Military Addition Replat of Block 32 a distance of 203.26 feet to a point 100.08 feet (100.00 feet Record) South of the centerline of Dry Creek, being the Southwest corner of a parcel described in Book 1235, Page 409 recorded at the Saline County Register of Deeds Office; 

Thence North 00'06’58 West on the West line of said parcel a distance of 100.08 feet to the centerline of Dry Creek; 

Thence North 27'45’35" East on said centerline and the West line of said parcel a distance of 11.91 feet; 

Thence North 04'06'47“ West on said centerline and the West line of said parcel a distance of 64.03 feet; 

Thence North 04’18’43" West on said centerline and the West line of said parcel a distance of 25.74 feet to the Northwest corner of said parcel; 

Thence North 89'57’19" East on the North line of said parcel a distance of 244.04 feet to the centerline of 12th Street, being the Northeast corner of said parcel; 

Thence South 00'06'58" East on said centerline and the East line of said parcel a distance of 200.15 feet to the extended North line of said Block 32, being the Southeast corner of said parcel; 

Thence South 89’57’29 West on said extended North line a distance of 40.00 feet to the point of beginning;

 

Said tract contains 1.11 Acres, more or less.

 

 (the “Property”)

 

Section 2.  Findings.  In relation to the Property, the Governing Body makes the following findings:

  1. The location and physical attributes of this property make it suitable for residential development
  2. The City has already extended utilities to this area, no additional public utilities would need to be provided
  3. Rezoning of the subject property for residential development could be viewed as contiguous, infill development of property that is already surrounded by the City.
  4. The subject site is adjacent to existing R-1 zoning on the east and south and a change to R-1 zoning would be compatible with the existing zoning pattern along N. 12th Street. 
  5. The requested zoning change and proposed residential density would be consistent with the city’s Comprehensive Plan which identifies the property as suitable for Urban Residential-type development.
  6. The Planning Commission conducted a public hearing on the application for rezoning the Property on July 1, 2025, after which the Planning Commission voted 8-0 to recommend that the Zoning Map of the City of Salina be amended to change the zoning classification of the Property from RS (Residential Suburban) to R-1 (Single-Family Residential) as requested, subject to satisfactory platting of the Property.

 

Section 3.  Subject to Platting.  As required by Salina Code Sec. 42-8 and consistent with the recommendation of the Planning Commission, amendment of the Zoning Map of the City of Salina to change the zoning classification of the Property from RS (Residential Suburban) to R-1 (Single-Family Residential) shall be subject to the precondition of platting of the Property in compliance with the City’s subdivision regulations (a) within one year from the date of publication of this ordinance or (b) if granted by the Planning Commission in advance, within one extension period not exceeding six months. If platting is not completed within the specified time, the Planning Commission shall recommend appropriate action to the governing body.

 

Section 4.   Amendment.  DISTRICT “R-1”.  Subject to satisfaction of the precondition set forth in Section 3 above, the Zoning District Map of the City of Salina, Kansas shall be amended to rezone the Property as part of DISTRICT “R-1” SINGLE-FAMILY RESIDENTIAL as of the date of the Mayor’s authorized endorsement of the plat.

 

Section 5.  Repealer.  All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance.

 

Section 6.  Publication.  The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.

 

Section 7.  Effective date.  This ordinance shall be in full force and effect from and after satisfaction of the precondition set forth in Section 3 above as of the date of the Mayor’s authorized endorsement of the plat.
