ORDINANCE NUMBER 25-11271
AN ORDINANCE AMENDING CHAPTER 8, ARTICLE I, OF THE SALINA CODE BY ADDING DIVISION 7 TO ADOPT AND INCORPORATE BY REFERENCE THE UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE, 2018 EDITION, WITH LOCAL AMENDMENTS.
BE IT ORDAINED by the Governing Body of the City of Salina Kansas:
Section 1. New Division. Salina Code Chapter 8, Article I, is amended to add a division to be numbered 7 to adopt and incorporate by reference the Uniform Swimming Pool, Spa and Hot Tub Code, 2018 Edition, promulgated and published by the International Association of Plumbing and Mechanical Officials, (USPSHTC), with local amendments to the following sections of the USPSHTC:
- Sec. 803.1 General.
- Sec. 803.3 Barrier Height.
- Sec. 803.4 Access Gates or Doors.
- Sec. 803.6 Aboveground Barrier.
Salina Code Chapter 8, Article I, Division 7, shall read as follows:
DIVISION 7. – ADOPTION OF THE UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE
Sec. 8-1-7-1. Uniform Swimming Pool, Spa and Hot Tub Code Adopted.
The Uniform Swimming Pool, Spa and Hot Tub Code (USPSHTC), 2018 Edition, promulgated and published by the International Association of Plumbing and Mechanical Officials, (USPSHTC), is adopted and incorporated by reference, except as amended in this division.
Sec. 8-1-7-803.1. Amendment to Section 803.1 of the USPSHTC.
Section 803.1 of the USPSHTC is amended to read as follows:
Sec. 803.1 General. Any outdoor swimming pool (including an inground, aboveground or onground pool), spa, or hot tub shall be provided with a barrier in accordance with Section 803.2 through 803.7 and enclosed on both sides. Powered safety covers of any design or materials, shall not be used in lieu of required barrier for pools and spas.
Sec. 8-1-7-803.3. Amendment to Section 803.3 of the USPSHTC.
Section 803.3 of the USPSHTC is amended to read as follows:
Sec. 803.3 Barrier Height. The top of the barrier shall be not less than 72” (1828 mm) above grade for Permanent in ground or above ground pools and not less than 48” (1473 mm) above grade for all Seasonal pools (all seasonal pools shall be of above ground construction/setup) and measured on the side of the barrier that faces away from the swimming pool, spa, or hot tub. The maximum vertical clearance between grade and the bottom of the barrier shall not exceed 4 inches (102 mm) measured on the side of the barrier that faces away from the swimming pool, spa, or hot tub. Where the top of the pool, spa, or hot tub structure is above grade, the barrier shall be permitted to be at ground level or mounted on top of the pool structure only where permitted by the manufacturer. Where the barrier is mounted on the top of the pool structure, the maximum vertical clearance between the top of the structure and the bottom of the barrier shall not exceed 4 inches (102 mm).
Sec. 8-1-7-803.4. Amendment to Section 803.4 of the USPSHTC.
Section 803.4 of the USPSHTC is amended to read as follows:
Sec. 803.4 Access Gates or Doors. Pedestrian access gates or doors shall comply with Section 803.1 through Section 803.3.5 and shall be equipped with self-closing and self-latching device. Gates or doors shall open outward or away from the pool, spa, or hot tub area. Gates or doors other than the pedestrian access gates or doors shall have a self-latching device. Where the release mechanism of the self-latching device is located less than 54 inches (137 mm) from the bottom of the gate or door, the release mechanism shall be located on the pool, spa, or hot tub side of the gate at not less than 3 inches (76 mm) below the top of the gate and the gate/door, and the barrier shall have no opening greater than ½ inch (12.7 mm) within 18 inches (457 mm) of the release mechanism. All Seasonal pool barrier fencing with gates less than 54 inches (1372 mm), the gates must be latched and locked securely as they cannot meet the 54 inches (1372 mm) height requirement for the self-latching device.
Sec. 8-1-7-803.6. Amendment to Section 803.6 of the USPSHTC.
Section 803.6 of the USPSHTC is amended to read as follows:
Sec. 803.6 Aboveground Barrier. Deleted.
Section 2. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 3. Effective date. This ordinance shall be in full force and effect from and after January 1, 2026.
