ORDINANCE NUMBER 25-11272
AN ORDINANCE CALLING A MAIL BALLOT QUESTION SUBMITTED ELECTION FOR A VOTE OF THE ELECTORS OF THE CITY OF SALINA, KANSAS, ON A QUESTION SUBMITTED PURSUANT TO K.S.A. 12-3013.
WHEREAS, the Saline County Clerk/Election Officer certified by letter to the City Clerk dated October 31, 2025, that a petition and proposed ordinance submitted pursuant to the initiative and referendum statute (K.S.A. 12-3013) under the title of “AN ORDINANCE REPEALING SALINA CODE CHAPTER 7, ARTICLE IX, DIVISION 1. – PIT BULL DOGS, SECTIONS 7-141, 7-142, 7-143, 7-144, 7-145, 7-146, 7-147, 7-148, AND 7-149 PERTAINING TO BREED SPECIFIC REGULATIONS AND DECLARING THAT ALL DOGS SHALL BE REGULATED IN THE SAME MANNER” (the “Proposed Ordinance”) was signed by the required number of qualified electors; and
WHEREAS, The Governing Body did not enact the Proposed Ordinance without alteration within 20 days of the attachment of the Saline County Clerk/Election Officer’s certificate to the accompanying petition and a regular city election is not going to be held within 90 days after the Saline County Clerk/Election Officer’s certification.
THEREFORE, BE IT ORDAINED by the Governing Body of Salina, Kansas:
Section 1. Question Submitted Election. In accordance with K.S.A. 12-3013, the Governing Body calls a mail ballot question submitted election for the purpose of submitting to the electors of the City of Salina, Kansas, the question submitted of whether the Proposed Ordinance shall be adopted. A copy of the Proposed Ordinance is attached and incorporated as though fully set forth in this ordinance. Based upon consultation with the Saline County Clerk/Election Officer, the date of the mail ballot question submitted election shall be February 24, 2026.
Section 2. Ballots. The ballots used when voting upon the Petitioned Ordinance shall set forth the Petitioned Ordinance in full.
Section 3. Adoption. If a majority of the qualified electors voting on the Proposed Ordinance votes in favor of the Proposed Ordinance, the Proposed Ordinance shall thereupon become a valid and binding ordinance of the City.
Section 4. Reimbursement for Direct Costs of the Election. The City Manager is authorized to reimburse Saline County for the direct expenses of the mail ballot question submitted election called pursuant to this ordinance in accordance with K.S.A. 25-2201(b).
Section 5. Delivery of this Ordinance. The City Clerk is directed to deliver a certified copy of this ordinance to the County Clerk/Election Officer and to request that the County Clerk/Election Officer take all steps necessary to conduct the mail ballot question submitted election called pursuant to this ordinance and the mail ballot election act.
Section 6. Publication of this Ordinance. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 7. Publication of Proposed Ordinance. The City Clerk shall cause the Proposed Ordinance to be published on the City’s website as the designated official city newspaper once each week for two consecutive weeks and not more than 20 or less than five days before the date of the mail ballot question submitted election in accordance with K.S.A. 12-3013(d).
Section 8. Effective date. This ordinance shall be in full force and effect from and after its publication.
