ORDINANCE NUMBER 26-11275

                                                                                                

AN ORDINANCE AMENDING ORDINANCE NUMBER 8526, CODIFIED AS CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP OF THE CITY OF SALINA, KANSAS BY REZONING AND PRESCRIBING THE PROPER USES OF CERTAIN PROPERTY WITHIN THE CITY.

 

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

 

Section 1.  Application.  Tyler Adams has filed Application #Z25-6 requesting a change in zoning district classification from PDD/R-2 (Multiple-Family Residential) to R-S (Residential Suburban) in relation to the following described tract of real estate:

            

            Lot 1, Block 5 of the Mariposa Addition to the City of Salina, Kansas. (the “Property”)

 

Section 2.  Findings.  In relation to the Property, the Governing Body makes the following findings:


  1. The location and physical attributes of this property make it suitable for residential development
  2. The City has already extended utilities to this area, no additional public utilities would need to be provided
  3. Rezoning of the subject property for residential development could be viewed as contiguous, infill development of property that is already surrounded by the City.
  4. The subject site is adjacent to existing R zoning to the south, R-1 zoning to the east and PDD/R zoning to the west and a change to R-S zoning would be compatible with the existing residential zoning pattern along Cedar Ridge Drive.
  5. The requested zoning change and proposed residential density would be consistent with the city’s Comprehensive Plan which identifies the property as suitable for Suburban Residential-type development.
  6. Due to the lack of development of multi-family residential housing as originally planned 37 years ago, the change in zoning from the existing PDD/R-2 zoning district to R-S is appropriate and would allow a previously undeveloped lot within the city to be developed.
  7. The Planning Commission conducted a public hearing on the application for rezoning the Property on January 6, 2026, after which the Planning Commission voted 8-0 to recommend that the Zoning Map of the City of Salina be amended to change the zoning classification of the Property from PDD/R-2 (Multiple-Family Residential) to R-S (Residential Suburban) as requested.


 

Section 3.   Amendment.  DISTRICT “R-S” RESIDENTIAL SUBURBAN.  The Zoning District Map of the City of Salina, Kansas is amended to rezone the Property as part of District “R-S” Residential Suburban and, in practical effect, to amend the Mariposa Addition P.D.D. by removing the Property from its boundary.

 

Section 4.  Repealer.  The provisions of Ordinance No. 89-9314 that relate to the Property are hereby repealed by adoption of this Ordinance.

 

Section 5.  Publication.  The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.

 

Section 6.  Effective Date.  This ordinance shall be in full force and effect from and after its publication.
