ORDINANCE NUMBER 26-11278
AN ORDINANCE AMENDING ORDINANCE NUMBER 8526, CODIFIED AS CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP OF THE CITY OF SALINA, KANSAS BY REZONING AND PRESCRIBING THE PROPER USES OF CERTAIN PROPERTY WITHIN THE CITY.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Application. Trevor Splichal on behalf of Salina Health Education Foundation, has filed Application #ZMA25-004 requesting a Zoning Map Amendment from PDD/I-2 (Planned Development District - Light Industrial) zoning district to C-3 (Shopping Center) zoning district in relation to the following described tract of real estate:
Lot 2 (less the east 200 feet and less the Edison Place right-of-way), Surveyor's Plat Number 52, City of Salina, Saline County, Kansas. (the “Property”)
Section 2. Findings. In relation to the Property, the Governing Body makes the following findings:
- The proposed map amendment replaces an obsolete 1979 Planned Development District tailored to the Property which is now a vacated utility storage yard.
- The Property is currently split-zoned, which inhibits unified site planning and cohesive redevelopment.
- Extending the existing C-3 zoning across the Property is a logical expansion of the commercial corridor along Ohio Street. The rezoning eliminates the pocket of industrial zoning in the immediate area, bringing the Property into conformity with the uniformly commercial and institutional character of the west side of South Ohio Street.
- The C-3 zoning district has a higher development standard than the I-2 district. Specifically, Salina Code Sec. 42-286 requires that all business, service, and storage activities in the C-3 district be conducted within a completely enclosed building, whereas the I-2 district permits exterior operations and outdoor storage yards (Salina Code Sec. 42-366). Furthermore, the I-2 district allows for unpaved, gravel parking and storage surfaces and does not mandate site landscaping. In contrast, development under the C-3 district requires fully paved off-street parking and formal street frontage landscaping. Because of these stricter development standards, the applicant's proposed rezoning will result in a aesthetic and functional upgrade to the neighborhood, ensuring the replacement of the existing chain-link fences, gravel surfacing, and exposed utility materials with a fully enclosed commercial/institutional facility, paved parking areas, and landscaped street frontages.
- Adequate public infrastructure already exists to serve the redevelopment.
- The proposed C-3 zoning classification is consistent with the Future Land Use Map designation of the Comprehensive Plan, which identifies the Property as "Commercial", a category that recognizes arterial corridor locations appropriate for retail, service, office, and civic uses. The proposed medical clinic use falls squarely within the range of uses contemplated by the Commercial designation and the location criteria applicable to that category.
- The Planning Commission conducted a public hearing on the application for rezoning the Property on March 17, 2026, after which the Planning Commission voted 6-0 to recommend that the Zoning Map of the City of Salina be amended to change the zoning classification of Lot 2 (less the east 200 feet and less the Edison Place right-of-way), Surveyor's Plat Number 52 from a Planned Development District (PDD) with an I-2 (Light Industrial) underlying zoning to C-3 (Shopping Center) district.
Section 3. Amendment. DISTRICT “C-3”. The Zoning District Map of the City of Salina, Kansas shall be amended to rezone the Property as part of DISTRICT “C-3” SHOPPING CENTER DISTRICT.
Section 4. Repealer. All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance.
Section 5. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 6. Effective date. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
