ORDINANCE NO. 26-11280


AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON CERTAIN PROPERTY TO PAY THE COSTS OF INTERNAL IMPROVEMENTS IN THE CITY OF CITY OF SALINA, KANSAS, AS PREVIOUSLY AUTHORIZED BY RESOLUTION NOS. 24-8242, 23-8115, 25-8295, 24-8219, 24-8232, 26-8341 AND 24-8205 OF THE CITY; AND PROVIDING FOR THE COLLECTION OF SUCH SPECIAL ASSESSMENTS.



WHEREAS, the governing body of the City of City of Salina, Kansas (the “City”) has previously authorized certain internal improvements (the “Improvements”) to be constructed pursuant to K.S.A. 12-6a01 et seq. (the “Act”); and


WHEREAS, the governing body has conducted a public hearing in accordance with the Act and desires to levy assessments on certain property benefited by the construction of the Improvements.


NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF CITY OF SALINA, KANSAS:


Section 1. Levy of Assessments. For the purpose of paying the costs of the following described Improvements:


Airport Industrial Center No. 3, Phase 1 - Utility, Street and Drainage


Resolution No. 24-8242

The curb, gutter, pavement, and grading for approximately 715 lineal feet of Scanlan Avenue and 1,050 lineal feet of Swanson Drive (the "Street Improvements").


The excavation of a detention basin and installation of approximately 1,515 lineal feet of storm sewer pipe, inlets, manholes and all appurtenances thereto (the “Storm Drainage Improvements”).


The installation of approximately 3,900 lineal feet of twelve-inch water main, valves, fittings, and all appurtenances thereto (the “Water System Improvements”).


The installation of approximately 3,632 lineal feet of twelve-inch sanitary sewer main, manholes, and all appurtenances thereto (the “Sanitary Sewer Improvements”).


(collectively, the "Improvements").


Cedar Point Addition - Utility, Street and Drainage


Resolution No. 23-8115 and 25-8295

The curb, gutter, pavement, and grading for approximately 379 lineal feet of Cedar Point Court, 520 lineal feet of Cedar Point Place, and 435 lineal feet of Cedar Ridge Drive (the “Street Improvements”).


The installation of approximately 717 lineal feet of storm sewer pipe, inlets, manholes and all appurtenances thereto (the “Storm Drainage Improvements”).


The installation of approximately 1,773 lineal feet of eight-inch water main, fire hydrants, valves, fittings, service connections for water lines and all appurtenances thereto (the “Water System Improvements”).


The installation of approximately 1,637 lineal feet of eight-inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the “Sanitary Sewer Improvements”).


(collectively, the "Improvements").


Lakeview Estates Addition No. 2, Phase 2 - Utility, Street and Drainage


Resolution No. 24-8219

The curb, gutter, pavement, and grading for approximately 374 lineal feet of Lake Way Drive and 565 lineal feet of Evening Bay Drive (the “Street Improvements”).


The installation of approximately 475 lineal feet of storm sewer pipe, inlets, manholes and all appurtenances thereto (the “Storm Drainage Improvements”).


The installation of approximately 44 lineal feet of six-inch water main, valves, fittings, service connections for water lines and all appurtenances thereto (the “Water System Improvements”).


The installation of approximately 345 lineal feet of eight-inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the “Sanitary Sewer Improvements”).


(collectively, the "Improvements").


Liberty Addition, No. 3 - Utility, Street and Drainage


Resolution No. 24-8232

The curb, gutter, pavement, sidewalk and grading for approximately 1,290 lineal feet of McIntosh Street (the “Street Improvements”).


The installation of approximately 1,112 lineal feet of storm sewer pipe, inlets, manholes and all appurtenances thereto (the “Storm Drainage Improvements”).


The installation of approximately 1,745 lineal feet of twelve-inch water main, valves, fittings, fire hydrants and all appurtenances thereto (the “Water System Improvements”).


The installation of approximately 794 lineal feet of eight-inch sanitary sewer main, manholes, and all appurtenances thereto (the “Sanitary Sewer Improvements”).


The installation of a two-barrel 9 ft. x 7 ft. reinforced concrete box culvert with an embedded roadway and sidewalks and all appurtenances thereto (the “RCB Improvements”).


(collectively, the "Improvements").


Stone Lake Addition, Phase 3b - Utility, Street and Drainage


Resolution No. 26-8341

The curb, gutter, pavement, and grading for approximately 1,418 lineal feet of Crystal Lake Drive, North Shore Drive, Crystal Lake Port and Crystal Lake Cove (the “Street Improvements”).


The installation of approximately 579 lineal feet of storm sewer pipe, inlets, manholes and all appurtenances thereto (the “Storm Drainage Improvements”).


The installation of approximately 898 lineal feet of eight-inch water main, fire hydrants, valves, fittings, service connections for water lines and all appurtenances thereto (the “Water System Improvements”).


The installation of approximately 1,175 lineal feet of eight-inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the “Sanitary Sewer Improvements”).


(collectively, the "Improvements").


Overlook Estates Addition - Utility, Street and Drainage


Resolution No. 24-8205

The curb, gutter, pavement, and grading for approximately 1,460 lineal feet of Overlook Drive (the "Street Improvements").


The installation of approximately 715 lineal feet of storm sewer pipe, inlets, manholes and all appurtenances thereto (the “Storm Drainage Improvements”).


The installation of approximately 1,215 lineal feet of twelve-inch water main, fire hydrants, valves, fittings,service connections for water lines and all appurtenances thereto (the “Water System Improvements”).


The installation of approximately 626 lineal feet of eight-inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the “Sanitary Sewer Improvements”).


(collectively, the "Improvements").


there are hereby levied and assessed the amounts (with such clerical or administrative amendments thereto as may be approved by the City Attorney) against the property described on Exhibit A attached hereto.


Section 2. Payment of Assessments. The amounts so levied and assessed in Section 1 hereof shall be due and payable from and after the date of publication of this Ordinance. Such amounts may be paid in whole or in part within thirty (30) days from the date of publication of this Ordinance or a summary thereof.


Section 3. Notification. The City Clerk shall notify the owners of the properties described in Exhibit A attached hereto (insofar as known to the City Clerk) of the amounts of their respective assessments. The notice shall also state that unless such assessments are paid within thirty (30) days from the date of publication of this Ordinance or a summary thereof, bonds will be issued therefor, and the amount of such assessment will be collected in installments with interest.


Section 4. Certification. Any amount of special assessments not paid within the time prescribed in Section 2 hereof shall be certified by the City Clerk to the Clerk of Saline County, Kansas, in the same manner and at the same time as other taxes are certified and will be collected in 20 annual installments, together with interest on such amounts at a rate not exceeding the maximum rate therefor as prescribed by the Act. Interest on the assessed amount remaining unpaid between the effective date of this Ordinance and the date the first installment is payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued to finance the Improvements, shall be added to the first installment. The interest for one year on all unpaid installments shall be added to each subsequent installment until paid.


Section 5. Effective Date. This Ordinance shall take effect and be in force from and after its passage, approval and publication of the Ordinance or a summary thereof once in the official City newspaper.
