ORDINANCE NUMBER 26-11282
AN ORDINANCE AMENDING ORDINANCE NUMBER 8526, CODIFIED AS CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP OF THE CITY OF SALINA, KANSAS BY REZONING AND PRESCRIBING THE PROPER USES OF CERTAIN PROPERTY WITHIN THE CITY.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Application. Troy Reinert, on behalf of City of Salina’s Building Maintenance Division, Parks and Recreation Department, has filed Application #ZMA26-002 requesting a Zoning Map Amendment from R (Single-Family Residential) zoning district to P-PF (Public Use - Public Facilities) zoning district in relation to the following described tract of real estate:
Lots 3-4, Block 7 of the Rolling Hills Addition, City of Salina, Saline County, Kansas. (the “Property”)
Section 2. Findings. In relation to the Property, the Governing Body makes the following findings:
- The subject property is not suitable for development under its existing R (Single-Family Residential) zoning. The site is fully developed with a specialized municipal structure constructed in 1969, featuring apparatus bays and commercial-grade infrastructure that do not accommodate standard single-family residential occupancy. The site is inherently suited for the range of civic and governmental uses permitted within the P-PF district.
- The proposed rezoning to P-PF (Public Use - Public Facilities) will not adversely affect the character of the surrounding properties. The site sits at a transitional boundary between residential and commercial zoning districts. Establishing the P-PF district provides a logical, step-down buffer between the C-1/C-3 commercial intensity and the R residential intensity. Any potential impacts from the specific establishment of a maintenance facility will be governed and mitigated through a subsequent Conditional Use Permit.
- Adequate public facilities and services are in place to support the P-PF zoning. The site is currently served by existing water, sanitary sewer, and storm drainage infrastructure, and the establishment of uses permitted within the P-PF district will not overtax these systems or increase the demand on public schools.
- The proposed rezoning will not create traffic congestion or safety hazards. Access to the site is provided via Briarcliff Road and Marymount Road with immediate proximity to Crawford Street, and the range of standard civic uses permitted within the P-PF district will utilize routine traffic patterns that are inherently safer than the historical high-speed emergency responses of a fire station.
- The requested P-PF zoning is in conformance with the Salina Comprehensive Plan, which designates this site as "Public / Semi-Public" on the Future Land Use Map. Applying the P-PF zoning district satisfies the plan’s development criteria by providing a transitional buffer to minimize operational impacts on surrounding neighborhoods.
- Approving the requested P-PF zoning will not harm the public welfare. The relative gain to the public in approving the map amendment is the affirmative benefit of adaptively reusing existing municipal infrastructure, which promotes civic operational efficiency and ensures the continued active maintenance of the site.
Section 3. Amendment. DISTRICT “P-PF”. The Zoning District Map of the City of Salina, Kansas shall be amended to rezone the Property as part of DISTRICT “P-PF” PUBLIC USE – PUBLIC FACILITIES DISTRICT.
Section 4. Repealer. All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance.
Section 5. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 6. Effective date. This ordinance shall be in full force and effect from and after its adoption and publication once by summary in the official city newspaper.
