RESOLUTION NO. 25-8320
A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS DETERMINING THAT THE CITY IS CONSIDERING AN EXPANSION OF THE SALINA DOWNTOWN REDEVELOPMENT DISTRICT, ESTABLISHING THE DATE AND TIME OF A PUBLIC HEARING ON SUCH MATTER, AND PROVIDING FOR THE GIVING OF NOTICE OF SUCH PUBLIC HEARING.
WHEREAS, the City Commission (the “Governing Body”) of the City of Salina, Kansas (the “City”) has heretofore, pursuant to the provisions of K.S.A. 12‑1770, et seq., as amended (the “Act”), passed Ordinance No. 15-10775 which established a redevelopment district within the City that was designated as the Salina Downtown Redevelopment District (the “District”); and
WHEREAS, on July 18, 2016, the Governing Body passed Ordinance No. 16-10843 removing certain real property from the District; and
WHEREAS, the Governing Body desires to modify the boundaries of the District by adding additional property as described herein (the “TIF Expansion Area”) to the District; and
WHEREAS, the TIF Expansion Area is eligible to be included within the District because it was designated by the City as an enterprise zone prior to July 1, 1992; and
WHEREAS, the City is required under the Act to conduct a public hearing in connection with the proposed expansion of the District to include the TIF Expansion Area.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS, AS FOLLOWS:
Section 1. The Governing Body finds that the TIF Expansion Area was designated as an enterprise zone within the City prior to July 1, 1992, and is therefore eligible to be included in the District. Notice is hereby given that a public hearing will be held by the City to consider the expansion of the District consisting of the addition of the TIF Expansion Area on December 22, 2025, at 4:00 p.m. or as soon thereafter as the matter can be heard, at the City Commission Chambers located in the City-County Building, 300 West Ash, Room 107. The Governing Body will consider the findings necessary for the expansion of the District after conclusion of the public hearing.
Section 2. A map of the proposed TIF Expansion Area is attached hereto as Exhibit A. A map of the entire District as expanded by the TIF Expansion Area is attached as Exhibit B. The boundaries of the TIF Expansion Area are legally described as shown on Exhibit C hereto. The legal description of the District as expanded by the TIF Expansion Area is attached hereto as Exhibit D.
Section 3. The City hereby ratifies the District Plan for the District, as expanded by the TIF Expansion Area, copied below as originally set forth in Ordinance No. 15-10775 of the City:
A mixed-use development consisting of some or all of the following uses: major multi-sport athletic complex, museum facilities; retail uses; restaurant uses; other general commercial development; hotel uses; residential uses; office uses; associated public and private infrastructure; and other items allowable under K.S.A. 12-1770 et seq. The redevelopment district may consist of multiple redevelopment project areas as delineated in one or more redevelopment project plans to be approved for property within the redevelopment district.
Section 4. A description and map of the TIF Expansion Area within the proposed expanded District are available for inspection and copying in the City Clerk, City-County Building, 300 West Ash, Room 206, Salina, Kansas 67402, Monday through Friday (other than holidays) between 8:00 a.m. and 5:00 p.m.
Section 5. The City Clerk is hereby authorized and directed to publish this resolution once in the official city newspaper not less than one week or more than two weeks preceding December 22, 2025, the date set for the public hearing. The City Clerk is also authorized and directed to mail a copy of this resolution via certified mail, return receipt requested to the board of county commissioners, the board of education of any school district levying taxes on property within the proposed expanded District, and to each owner and occupant of land within the proposed expanded District, not more than 10 days following the date of the adoption of this Resolution.
Section 6. The City Manager, City Clerk, City Attorney and other officials and employees of the City are hereby further authorized and directed to take such other actions as may be appropriate or desirable to accomplish the purposes of this resolution.
Section 7. This resolution shall be effective upon its adoption by the Governing Body.
